I. Scope of application, conclusion of contract

The Tourismusverband Mühlviertel acts as an intermediary in the business relationship with a booking party. A contract is therefore concluded between the person making the booking and the accommodation provider (accommodation provider). The following General Terms and Conditions apply to this contract in the version valid at the time of booking. Any mutual claims arising from this contract are only to be asserted against the direct contractual partner and without any liability or joint liability on the part of the Tourismusverband Mühlviertel. The Tourismusverband Mühlviertel will agree with the person making the booking that the "General Terms and Conditions for the Hotel Industry (ÖHVB)" decided on 15 November 2006 as well as the supplementary General Terms and Conditions listed here are legally valid for the accommodation contract and for the mediation of the same.

II. in particular the section "Withdrawal from the accommodation contract - cancellation fee" (§ 5) is excerpted from the current AGBH 2006:

• 5.1 If the Accommodation Agreement provides for a down payment and the down payment has not been made by the Party in due time, the Proprietor may withdraw from the Accommodation Agreement without granting a grace period.

• 5.4 Unless otherwise agreed, the Proprietor may unilaterally terminate the Accommodation Agreement for objectively justified reasons no later than 92 days prior to the agreed date of arrival of the Party.

• 5.5 The Accommodation Agreement may be terminated by the Party by means of a unilateral declaration by no later than 92 days before the agreed date of arrival of the Guest without payment of a cancellation fee.

• 5.6 Outside the period specified in § 5.5, cancellation by unilateral declaration by the contracting party is only possible subject to payment of the following cancellation fees: - up to 30 days before the date of arrival 40% of the total package price; - up to 7 days before the date of arrival 70% of the total package price; - 6 days to the date of arrival 90% of the total package price.

III Supplementary General Terms and Conditions:

• 1. the booking only becomes valid once the host has confirmed the booking. Without a booking confirmation, no valid contract is concluded and the guest has no certainty that the booked service is actually available.

• 2. the contracting parties agree that the accommodation contract and the agency contract shall be governed by Austrian law.

• 3. no ancillary agreements have been made.

• 4. amendments and supplements to this contract must be made in writing to be legally effective.

• 5. it is agreed that the district court of Rohrbach-Berg shall have jurisdiction over any disputes arising from this legal transaction - including disputes regarding the existence of the legal transaction.

• 6. place of fulfilment of the services of the Mühlviertel Tourist Association is the municipality of Bad Leonfelden.

• 7. the accommodation provider expressly confirms that the AGBH 2006 are legally effective for all mediations; in addition, the accommodation provider declares to be fully aware of the General Terms and Conditions, to have received them and to accept them in full for each mediation.

• 8. the Tourismusverband Mühlviertel guarantees that the customer data will only be collected, processed, stored and used for its own marketing purposes in connection with the processing of the travel arrangement. The Tourismusverband Mühlviertel will only pass on customer data to involved hosts to the extent necessary for order processing. If guests do not wish to receive marketing information, please inform us accordingly.

• 9. no liability is assumed for the accuracy of the content of the image material provided by the accommodation providers.
